1. Acceptance of Terms

By accessing or using Sales Wizard ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Sales Wizard is a sales coaching platform that records, transcribes, and analyzes sales calls to provide actionable feedback and performance metrics. The Service includes iOS and web applications.

3. User Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to:

  • Record calls without the consent of all parties where required by law.
  • Use the Service for any illegal or unauthorized purpose.
  • Attempt to reverse-engineer, decompile, or disassemble the Service.
  • Upload malicious content or interfere with the Service's operation.
  • Share your account credentials with unauthorized parties.

5. Recording Consent and Compliance with Law

Sales Wizard is a tool that enables users to record, transcribe, and analyze conversations. You, the user, are solely responsible for ensuring that any recording you make using the Service complies with all applicable federal, state, local, and international laws, including but not limited to wiretap, eavesdropping, electronic surveillance, and consumer privacy statutes.

By using the Service, you represent and warrant that:

  • You have the legal authority to record any conversation you record using the Service.
  • You will obtain any consent required under the laws of every jurisdiction in which the conversation takes place. You acknowledge that some U.S. states require the consent of all parties to a conversation (commonly known as "two-party" or "all-party" consent states), while others permit recording with the consent of only one party. Two-party-consent states currently include, but may not be limited to, California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania, Vermont, and Washington. State laws change; you are responsible for verifying the current law in your jurisdiction before recording.
  • You will not use the Service to record any conversation in violation of any law.
  • If you are recording on behalf of an organization, you represent that you have authority to bind that organization to these Terms and to the representations in this Section.

Sales Wizard does not provide legal advice. Nothing in the Service or these Terms constitutes legal advice regarding recording laws. If you are unsure whether a particular recording is lawful, consult a licensed attorney before recording.

You agree to indemnify, defend, and hold harmless Sales Wizard, its officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) any recording you make using the Service; (b) your breach of the representations in this Section; or (c) any third party's claim that a recording made using the Service violated their rights under any wiretap, eavesdropping, privacy, or similar law.

6. Intellectual Property

You retain ownership of your recordings, transcripts, and data. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you. We do not claim ownership of your content.

7. AI Analysis Disclaimer

Sales Wizard uses artificial intelligence to analyze transcripts and provide coaching recommendations. AI-generated insights are provided for informational purposes only and should not be considered professional advice. Results may vary and are not guaranteed.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Sales Wizard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total cumulative liability to you for any claim arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these terms. You may delete your account at any time through the app settings.

10. Changes to Terms

We may update these terms from time to time. We will post the updated terms on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated terms. You are responsible for reviewing these terms periodically.

11. Open-Source Software

Sales Wizard includes open-source software. On-device speaker separation uses the pyannote Community-1 models, licensed under Creative Commons Attribution 4.0 (CC-BY-4.0), based on work by Plaquet and Bredin (2023, speaker segmentation), Wang and colleagues (2023, WeSpeaker speaker embeddings), and Landini and colleagues (2022, VBx clustering). These models run through FluidAudio (Apache License 2.0). Sales Wizard also uses supabase-swift (MIT), Sentry (MIT), and Google Sign-In (Apache License 2.0). Each project's full license text is available from its respective source repository.
